Car Park Opening Hours: Centre Car Park. Monday-Saturday 6.30am-Midnight. Sunday 8am-Midnight. Moor Street (Selfridges) Car Park. Monday-Saturday 6.45am-10pm. Sunday 9am-8pm. Edgbaston Street

(Debenhams) Car Park. Monday-Sunday 5.30am-Midnight.

Please note that times may vary at Christmas, Easter and Bank Holidays.

 

Car Park Terms and Conditions

These Terms and Conditions apply to the entry to and use of this car park - please read them carefully. If you do not accept these Terms and Conditions, please exit this car park immediately and do not park. We

reserve the right to refuse admission to any person or vehicle at any time

 

Entry: You must only park your vehicle during the opening hours (as set out on the notice board at the entrance to this car park). On entry, you must take a ticket from the machine to activate the entry barrier. You must

retain your ticket as you will need your ticket to exit this car park following payment. This is a short term car park and is not intended for long term parking.

 

Parking your Vehicle: You must only park your vehicle in the designated parking areas. Only vehicles that display a valid disabled parking permit are permitted to park in the areas designated for disabled users. You

must comply with all reasonable instructions of our staff. If you are unable to find a parking space you should exit the car park immediately, or you are likely to incur parking charges.

 

Securing your Vehicle: You must ensure that your vehicle is securely locked at all times whilst parked. Please ensure that your windows are fully closed and any security devices used. Please do not leave your entrance

ticket or any valuables or other possessions in your vehicle or where they are clearly visible. You should ensure that you have appropriate insurance in place to cover all possessions, as they may not be covered under

your vehicle insurance policy.

 

Cameras: CCTV and automatic number plate recognition (ANPR) cameras are installed in this car park. These cameras are necessary to assist us in providing you with a secure car park service (although neither your

security nor the security of your vehicle can be guaranteed where these cameras are in place), including for the prevention and detection of crime. These cameras may collect your personal data (This information will

be available via our privacy notice - this is available from our website or in writing to Bullring Management).

 

Safety: You must drive carefully and obey the speed limits and any directional and other signs. After you have parked and secured your vehicle, you should proceed to the nearest passenger lifts, stairs or exits as sign

posted on each level. Please be careful of other vehicles being driven and do not leave children unsupervised in the car park or your vehicle.

 

Charges: This car park charges for parking. The charges are displayed at the entrance to this car park and at the payment machine points. The ticket issued on entry to the car park can only be used for the vehicle for

which it was issued and cannot be transferred to another vehicle. The charges are based on the period that your vehicle is parked. If your vehicle is parked overnight, then an overnight charge will also apply.

 

Payment: You must pay for your parking at the designated payment machine points prior to your exit using the ticket issued to you on entry. If you have lost or cannot produce your ticket, you must pay a charge

equivalent to the period from the time of opening on the day of your entry until the time of your exit.

 

Our Responsibilities: Please remember this car park is a public place and we cannot guarantee the safety of any vehicle, its contents or of any person. Accordingly, you park in this car park at your own risk.

 

We will only be responsible for: any death or injury caused by our negligence; and any loss or damage to or theft of your parked vehicle in this car park to the extent that it was reasonably foreseeable on entering

into the contact with you under these terms and conditions, caused by our negligence, or caused by our default or breach of duty under these terms and conditions.

 

We have the right to refuse entry to the car park, or to ask to leave the car park, anyone who is or has been causing any damage to property, causing a breach of the peace or misbehaving in any way, or who has no

reason to be present on the car parking premises.

 

Reporting of Incidents: If your vehicle has been damaged or stolen or if you have damaged another vehicle you should report the matter immediately to the vehicle owner (where applicable) and a member of staff,

together with the registration number(s). You should also notify your insurers and, in the case of theft, the Police. Centre management can be contacted via details shown below.

 

Restrictions: You are not permitted to use the car park for any purpose other than the parking of your vehicle. In particular, any work (including repairs, or cleaning or towing of vehicles) or any activity in connection

with the sale, hire or disposal of vehicles or other items, are prohibited. If your vehicle has broken down you should notify a member of staff immediately so that we may ensure that any necessary steps are taken to

prevent an obstruction or a risk to health and safety of any other person or property in the car park.

 

We reserve the right to refuse you entry to and/or ask you to leave the car park in the event of an emergency which we reasonably consider to pose a risk to health and safety of any person or property in the car park,

including but not limited to, natural disaster, fire, act or threat of terrorism or any other event or circumstance to the extent it is beyond our reasonable control.

 

Relocation of Vehicles: We reserve the right, by driving or otherwise, to relocate your vehicle for the proper operation of this car park, including if your vehicle is causing an obstruction or a risk to health and safety

or in an emergency.

 

Abandonment of Vehicles: If we reasonably believe that a vehicle has been abandoned, we reserve the right to remove and sell the vehicle. Prior to any sale we will make reasonable enquiries to identify and

contact the registered owner and give notice of our intention to sell the vehicle if it is not collected within 30 days. The proceeds of sale will be used to satisfy any parking charges and other costs in connection with the

removal, storage and sale of the vehicle. The balance will be held on behalf of and paid to the registered owner on proof of ownership.

 

Exit: You can only exit this car park on production of a paid and validated ticket and we reserve the right to refuse exit to any vehicle for which a paid and validated ticket has not been produced, until further enquires

are concluded. Where a paid and validated ticket has not been produced, you will be charged at the full day rate for each day, or part thereof, that your vehicle remains in this car park. If your vehicle is still parked

after this car park closes, you will not be able to exit until this car park re-opens.

 

General: A delay in exercising or failure to exercise a right or remedy under or in connection with these terms and conditions will not constitute a waiver of, or prevent or restrict future exercise of, that or any other

right or remedy, nor will the single or partial exercise of a right or remedy prevent or restrict the further exercise of that or any other right or remedy.

 

If any of these terms and conditions (including any exclusion from, or limitation of, liability set out above) is found by any court or body or authority of competent jurisdiction to be illegal, unlawful, void or unenforceable,

such term will be deemed to be severed from these terms and conditions and this will not affect the remainder of the terms and conditions which will continue in full force and effect.

 

No variation to these terms and conditions will be effective unless they are in writing and signed by Bullring Management. These terms and conditions may be amended from time to time.

We do not intend that any of these terms or conditions will be enforceable under the Contracts (Rights of Third Parties) Act 1999 by any person.

 

Our rights and remedies set out in these terms and conditions are in addition to and not exclusive of any rights and remedies provided by law.

 

These terms and conditions and our contract with you will be governed by the law of England and Wales. The courts of England and Wales will have exclusive jurisdiction to determine any dispute arising out of or in

connection with our contract with you (including in relation to any non-contractual obligations).

 

Any reference to ‘we’, ‘us’ or ‘our’ above is a reference to the owners of this car park, Bullring Limited Partnership together with the designated operators and centre management, as appropriate. Any reference to

‘vehicle’ includes any mechanically operated machine and its related equipment.
